Waiver & Release of Liability

I am aware that open water activities in general, and surfing specifically, involve inherent risks, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury including paralysis and even death does exist. I acknowledge that surfing can be dangerous and I accept and assume such risks, both known and unknown, even if arising from the negligence of the instructor or others, and assume full responsibility for my participation or the participation of my child.

I grant East Coast Surf School the right to, and acknowledge that they may use my name, likliness, portrait, recorded voice, photographs, biographical sketch, film and videos of me in advertising, marketing, product, packaging or other use, without compensation and without restriction as to duration, geography, media or frequency.

I waive my right to sue East Coast Surf School or any of it’s owners, instructors, agents or employees. In consideration for East Coast Surf School agreeing to provide me with surfing instruction and allowing me to participate in this class or lesson and/or rental of surfing equipment, wetsuits, boogie boards to use at my own discretion.

I agree that I shall not make a claim or bring any action against, sue, or hold responsible, the City of Halifax, Department of Natural Resources or East Coast Surf School, it’s owners, officers, agents, employees, associates, representatives, (referred to collectively in this agreement as East Coast Surf School) or expect, require, or pursue them, to be held accountable for any damages. I also understand that East Coast Surf School is not responsible for any lost or stolen items.

I voluntarily agree to release, discharge, and hold harmless East Coast Surf School from and against any and all claims of liability, even those arising out of their negligence, fault, recklessness, or any other act or omission which causes me damages, illness, injury, disease, or death, of any nature in any way connected with my participation in this activity. I also expressly agree to release and discharge East Coast Surf School from any act or omission, in rendering or failing to render any type of rescue, emergency or medical services.
